Terms of service

The agreement, in language you can hold us to

These terms govern your use of TheraBoard. They are deliberately short. Where a term protects us at your expense, it says so rather than hiding in a clause.

Who can use it

TheraBoard is for practising mental-health professionals. You must be legally able to enter a contract, and qualified and permitted to provide the services you use it to run. You are responsible for keeping your login credentials secure; anything done through your account is treated as done by you.

What TheraBoard is not

• The questionnaires it administers (PHQ-9, GAD-7, WHO-5, ORS) screen and monitor. They do not diagnose. The app says so on every screen that shows a score.
• The "at risk" flag is a pattern in attendance and scores. It is not a clinical risk assessment, and the app reports its own accuracy precisely so you can judge how much weight it deserves.
• AI-written text is a drafting aid. You are responsible for what ends up in a clinical record.
• It is not for emergencies. It does not monitor anyone in real time and nobody is watching it. In a crisis use Tele-MANAS (14416), AASRA (9820466726) or 112.

Your data is yours

You own your practice records. We claim no ownership and no licence to use them beyond operating the service for you. You can export everything, at any time, in a machine-readable format, with no request, negotiation or fee. If you leave, you leave with your data.

We will not use your client records to train models, ours or anyone else's.

Your responsibilities

• Consent and lawful basis. You are the data fiduciary for your clients' records. Obtaining valid consent and meeting your professional obligations is your job; the app gives you the tools to evidence it.
• Accuracy. What goes into the record is what you put there.
• Professional standards. Your registering body's rules on record-keeping, confidentiality and supervision apply to you regardless of what this software permits.
• Reasonable use. Do not attempt to breach the service's security, access another practice's data, or use it to harm anyone.
• Your keys. If you add your own AI provider key, that provider's terms and costs are between you and them.

Plans and payment

• Every account starts with a 14-day Pro trial. No card is required to begin.
• After the trial you move to the free Starter plan and keep your data. Starter caps the number of active clients; nothing is deleted when you reach the cap.
• Paid plans are billed monthly in advance. Prices are shown on the site before you pay.
• Cancel any time. Cancellation stops the next charge and you keep access until the end of the period you have paid for. We do not pro-rate part months.
• If we raise prices, existing subscribers get at least 30 days' notice and can cancel first.

Availability

We work to keep TheraBoard available and quick, but we do not promise a specific uptime figure we have not earned the right to promise. The app installs to your device and opens with your last known data when offline, and writes made offline sync when you reconnect, which limits how much an outage can cost you. Planned maintenance will be announced where we reasonably can.

Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that: the service is provided as it is; we are not liable for indirect or consequential loss, lost profits, or lost goodwill; and our total liability in any twelve-month period is limited to the amount you paid us in that period. If you are on a free plan, that amount is nil, which is a real limitation and you should read it as one.

We are not liable for clinical decisions. You are the clinician.

Ending the agreement

You can stop using TheraBoard and delete your account whenever you like, from Settings. Deletion removes your data from the live database immediately and cannot be undone, so export first.

We may suspend or end an account that breaches these terms, that is used unlawfully, or that puts other users at risk. Except where the breach is serious or we are legally required to act at once, we will warn you first and give you a chance to export your data. If we discontinue the service entirely, we will give at least 60 days' notice and keep exports working throughout.

Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction. If any part of these terms is found unenforceable, the rest continues to apply.
